England, UK: OFT Seeks Independent Input into Shell-Rontec Deal

The Office of Fair Trading (OFT) is seeking independent retailers to offer evidence for an inquiry into Shell’s acquisition of 253 fuel service stations – currently operating under the Total brand – from Rontec. The enquiry by the OFT is aiming to establish whether the acquisition by Shell would create local market dominance in any area and should therefore be referred to the Competition Commission.
Retailers are being urged to provide details of stations that may be affected in the same or adjacent postcode as the sites involved in the transaction by a December 20 deadline. Concerned retailers have been advised to email

naming the postcode of any stations they believe may be affected if stations currently carrying the Total brand are rebranded as Shell sites. They will then be asked to complete a questionnaire and write to the mergers branch at the OFT to confirm that they will comply with the confidentiality terms of the investigation.
The identity of the 253 former Total sites is not to be made public. Therefore, retailers who receive information on the stations are obliged to confirm that the data will only be used for submitting evidence and that records will be destroyed once a submission is made.
